CBD Cross-cutting issues

 

Access to Genetic Resources and Benefit-sharing.

 

- One of the three objectives of the CBD, as set out in Article 1, is the 'fair and equitable use of the benefits arising out of the utilisation of genetic resources, including by appropriate access to genetic resources and by appropriate transfer of relevant technologies, taking into account all rights over those resources and to technologies, and by appropriate funding'. A framework for the implementation of this objective with regard to access to genetic resources is provided in Article 15 of the CBD.

 

- Article 15(6) requires Contracting Parties to endeavour to develop and carry out scientific research based on genetic resources provided by other Contracting Parties with the full participation of, and where possible in, such Contracting Party countries.

 

- Article 15(7) requires each Contracting Party to take legislative, administrative or policy measures with the aim of sharing in a fair and equitable way the results of research and development and the benefits arising from the commercial and other utilisation of genetic resources with the Contracting Party providing such resources.
